Team Contract 2025-2026 Please read carefully as this contract contains your agreement to specific policies and financial commitments.Section 1A gymnastics season begins on July 1 of a calendar year and ends on June 30 of the following calendar year. This contract with the Edmonton Acrobatic Gymnastics is a commitment from your start date in the program until the end of the gymnastics season to which it applies. The deadline to withdraw without penalty is 30 days following the signing of this contract. After this time, program fees are subject to Edmonton Acro Withdrawal Policy as detailed below. In the event of withdrawal from a program, all outstanding fees must be paid within 30 days of notice. Acrobatic Gymnastics is a team sport. Regularly working with the assigned unit (partners, trios, etc) is absolutely imperative for the success of the individual and the unit. Attendance directly affects the success, confidence, performance and morale of the others in the unit. Excessive absenteeism will result in a request for a meeting to discuss the issues ongoing issues may result in expulsion from the unit or team. Members unable to be placed in a Competitive unit due to the unavailability of a suitable matchup can continue to train with the Competitive Team doing conditioning, flexibility training, individual skills, tumbling, blocks and skill building for potential group performances (demos) while efforts are made to find a suitable match. If circumstances require a unit change at any time during the year, partial units will be allowed to continue training with Competitive Team until a new match is found or in a non-competing status based on Head Coach recommendation. If the coach(es) are unable to provide a suitable option within 30 days, or the next competition event (whichever comes first), the head coach may release the contract, subject to any outstanding fees payable.Section 1 Consent* I agree to terms outlined in section 1.Section 2Please carefully read and check to indicate your understanding and consent to each of the following terms:Tuition* The gymnastics term is from July 1, 2025 to June 30, 2026. Tuition is for in gym scheduled training for the entire term. Full tuition is due upon registration however a 0% interest equal monthly instalment plan is applied for the duration of the remaining term. This monthly instalment plan does not constitute a monthly pay-as-you-go format. Tuition is non-refundable.Team Handbook* The team handbook contains additional team and club policies. I have reviewed the current team handbook and I agree to be bound by the policies within. (View handbook)Performance Events* Prior to performance events , athletes participating in the event must be present for a minimum of two weeks. Unexcused absences, including vacations, may result in being pulled from participating in the event without refund for event fees.Competition Events* Prior to competitions , athletes participating in the event must be present for training for the 6 training days prior to the event. Unexcused absences, including vacations, may result in being pulled from participating in the event without refund for event fees.Vacation / Absence Notice* All vacations during the gymnastics season must be cleared with the head coach in writing. Any vacations longer than 1 week require a minimum 30 days notice. More notice is appreciated. Short notice or excessive vacations may result in; the unit being pulled from participating in various events, changes in the assigned group or level or other necessary changes as required by the head coach without refund.Disciplinary Action* I understand that disciplinary actions may include sending the participant home or other reasonable actions at the discretion of the head coach. If the disciplinary action includes removal from training or an event, there will be NO REFUNDS for the missed training or related fees.Choreography* Choreography fees are for time spent working with a professional choreographer if applicable, all choreography, artistry thereof and related accompaniment remains property of Edmonton Acro and is not transferable without written permission from the head coach.Payment Terms* Monthly installments are processed on the 1st (first) day of each month. If an installment payment fails, we will retry between 1 and 10 business days. If the installment payment fails after the second attempt, a $25 late processing fee will be applied. If installments fall more than 30 days behind: a) the athlete may be prohibited from participating in training or events. b) failure to pay does not constitute withdrawal from the program and balance of tuition will become collectable in the event of failure to pay installments. Any costs associated with collection of fees and late payments, including any administrative or legal fees from collections action will be the responsibility of the participant or guardian.Program Withdrawal* The deadline to withdraw without penalty is 30 days from the date this contract is signed. If I choose to withdraw mid-season, I will be required to pay all remaining tuition in full within 30 days of notice of withdrawal subject to employment loss clause below.Employment Loss* In the event of loss of employment due to government order, natural disaster or pandemic, withdrawal from the program will be permitted without penalty. However, any unpaid balance and non-refundable event fees will be due upon notice of withdrawal.Membership Fees* Club and/or provincial and national federation membership fees are non-refundable for any reason. Withdrawal from the program prior to paying these fees in full when splitting the payment will require complete of payment of remaining amount within 30 days of withdrawal.Alternative Delivery* In the event of a temporary facility closure or programming change due to government order, natural disaster, or otherwise, Edmonton Acro will provide alternative delivery of training such as online or outdoor or other format and monthly payments will continue to be due.Athletes Pulled from Events* If an athlete is pulled from an event for non-payment of any outstanding fees, behaviour, lack of attendance, or otherwise at the digression of the head coach, event fees and costs will be forfeited and will not be refunded. Additionally, if the action results in a partner or group being unable to participate, the penalized athlete or guardian will be responsible for their partner/groups non-refundable fees as well.Program Expulsion* If an athlete quits or is expelled from the team for behavior, lack of attendance, or otherwise at the digression of the head coach, any installments paid to date or other collected fees will not be refunded. At the digression of the head coach and/or club administration, any balance outstanding on a payment plan may be cancelled. Event registration and other non-refundable fees of their partner(s) unable to participate in events as a result may be added to any outstanding balance, subject to the discretion of the head coach. Should a suitable replacement athlete be arranged, who is able to take their spot without additional cost, any partner event fees may be refunded if they can be transferred.Adherence* I will ensure that the named athlete and guardians (if the athlete is a minor) will abide by Edmonton Acro’s team policies at all times.Teamwear* I understand that I will be required to purchase or acquire the current season approved teamwear including a training leotard, performance leotard or other performance wear, team jacket, team shorts or other teamwear that I do not already own.Coach Authority* Regardless of my background or education, I will recognize the authority and expertise of the team coach(es) and will defer all training decisions to those individuals. Any questions I have relating to training will be presented in a respectful and professional manner.Event Attendance* I understand that I am responsible to ensure attendance of the above named athlete at all mandatory events listed in this contract. This will include providing transportation and accommodation for the athlete, not included in the fees outlined below, according to the travel policies used for each event. This contract with the Edmonton Acrobatic Gymnastics is a commitment from your start date in the program until the end of the gymnastics season to which it applies. Acrobatic Gymnastics is a team sport. Regularly working with the assigned unit (partners, trios, etc) is absolutely imperative for the success of the individual and the unit. Attendance directly affects the success, confidence, performance and morale of the others in the unit. Excessive absenteeism will result in a request for a meeting to discuss the issues and may result in expulsion from the unit or team. (View handbook)Section 1 Consent* I agree to the terms outlined in Section 1.Section 2Please carefully read and check to indicate your understanding and consent to each of the following termsPlease check each of the following confirming you have read and agree to each point (Check All)* Prior to performance events where the athlete is registered, they must be present for a minimum of two weeks (2 training days). Athletes are expected to train and perform to the best of their ability at all times. In addition to their own development, each athlete contributes to the success of their pair or group. Failure to demonstrate consistent effort, participation, or determination may result in disciplinary action. I understand that disciplinary actions may include being sent home or other reasonable consequences at the discretion of the head coach. If removal from training or an event occurs, I acknowledge that no refunds will be issued for missed training or associated fees. Monthly training fees cover pre-scheduled training only. They do not include travel costs, optional camps, team uniforms, event entry fees, coach expenses, choreography, or similar items. Any additional fees will be due according to the payment schedules provided by the host organizations. In the event of a temporary facility closure or program change due to government order, natural disaster, or other circumstances, Edmonton Acro will provide alternative training (e.g., online, outdoor, or otherwise). Monthly fees will continue to be due. The gymnastics season runs from July 2025 to June 2026. Monthly fees are calculated as a total for the season based on the athlete’s start date, then divided into equal monthly instalments. Withdrawal from the program requires a minimum of 30 days’ notice (one full monthly payment). If an athlete voluntarily quits or is expelled from the program due to behavior, lack of attendance, or other reasons at the discretion of the head coach, I understand that all fees paid to date are non-refundable. Outstanding payments on an instalment plan may be cancelled at the discretion of the head coach and/or club administration. I understand that I will be required to purchase or acquire the approved training leotard for the current season if I do not already own one that fits and is in good condition. I recognize the authority and expertise of the coaching staff and will defer all training-related decisions to them. Part 1 Agreement* I have read and agree to be bound by paragraphs 1 and 2Part 2Description and Acknowledgement of Risks I understand and acknowledge that a) The Activities have foreseeable and unforeseeable inherent risks, hazards, and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, permanent disability, paralysis, and loss of life. b) The Organization may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming. c) The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction; and d) The Organization has put in place preventative measures to reduce the spread of contagions; however, the Organization cannot guarantee that I will not become infected by a contagion. Further, participating in the Activities could increase my risk of exposure and/or illness from infectious disease and contagions. I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the Activities. The risks, dangers and hazards include, but are not limited to: a) Contracting COVID-19 or any other contagious disease. b) Privacy breaches, hacking, technology malfunction or damage. c) Executing strenuous and demanding physical techniques and exerting and stretching various muscle groups. d) Vigorous physical exertion, strenuous cardiovascular workouts and rapid movements. e) The failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment or apparatus. f) Failure to follow instructions or rules. g) Spinal cord injuries which may render me permanently paralyzed. h) Serious injury to virtually all bones, joints, ligaments, muscles, tendons, and other aspects of my body or to my general health and well-being. i) Abrasions, sprains, strains, fractures, or dislocations. j) Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma. k) Physical contact with other participants, spectators, equipment, and hazards. l) Collisions with walls, any gymnastics apparatus, floors or mats. m) Falling, tumbling, or hitting any gymnastics apparatus, the floor, mats, or other surfaces. n) Physical contact with other participants (including spotters). o) Not wearing appropriate safety or protective equipment. p) Failure to act safely or within my own ability or designated areas. q) Negligence of other persons, including other spectators, participants, or employees. r) Travel to and from competitive events and associated non-competitive events which are an integral part of the Activities; and s) Negligence on the part of the Organization, including failure by the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with my participation in the Activities. Part 2 Agreement* I have read and agree to be bound by paragraphs 3 and 4Part 3Terms In consideration of the Organization allowing me to participate in the Activities, I agree: a) That when I practice or train in my own space, I am responsible for my surroundings and the location and equipment that I select. b) That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental and physical condition. c) That I may experience anxiety while challenging themselves during the Activities. d) To comply with the rules and regulations for participation in the Activities. e) To comply with the rules of the facility or equipment. f) That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring my observations to a representative of the Organization immediately. g) The risks associated with the Activities are increased when I am impaired, and I will not participate if impaired in any way. h) That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an Activity, I acknowledge and accept the suitability and conditions of the Activity. i) That COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death; and j) That I am responsible for my choice of safety or protective equipment and the secure fitting of that equipment. Release of Liability and Disclaimer In consideration of the Organization allowing me to participate, I agree: a) That the sole responsibility for my safety remains with me. b) To ASSUME all risks arising out of, associated with, or related to my participation. c) That I am not relying on any oral or written statements made by the Organization or its agents, whether in a brochure or advertisement or in individual conversations, to agree to participate in the Activities. d) To WAIVE any and all claims that I may have now or in the future against the Organization. e) To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, loss of life, property damage, expense, and related loss, including loss of income, resulting from my participation in the Activities. f) To FOREVER RELEASE the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization; g) To FOREVER RELEASE AND INDEMNIFY the Organization from any action related to my becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of myself or others, including but not limited to the Organization; h) That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities. i) That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities; and j) This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Alberta and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.
